Welcome to Herb Sprouts Learning. By accessing our website Herbsproutslearning.com and purchasing or using our educational services, you agree to be bound by the following Terms & Conditions.

If you do not agree, please do not use this website or purchase our services.

1. Educational Purpose Only

Our herbalism lessons, including all live Zoom classes, recordings, and downloadable materials, are provided for educational purposes only and are designed for minors under the supervision of a parent or legal guardian.

We do not provide medical advice, diagnosis, or treatment. Nothing in our classes, videos, PDFs, or communications should be considered a substitute for professional medical advice, diagnosis, or treatment.

2. Eligibility & Guardian Consent

By enrolling a child, you confirm that:

  • You are the child’s parent or legal guardian

  • You consent to the child’s participation in all classes and activities

  • You will supervise all hands-on activities, including herb handling, preparation, and any at-home experiments

  • You accept full responsibility for your child’s participation in both live and recorded instruction

3. ESA / EFA Funding (Arizona & Arkansas)

Some services may be eligible for reimbursement or payment through Arizona ESA (Empowerment Scholarship Accounts) and Arkansas EFA (Education Freedom Account) programs.

By purchasing using or intending to submit for ESA/EFA funding, you acknowledge that:

  • Approval, eligibility, and reimbursement are not guaranteed

  • Each state program (including Arizona ESA and Arkansas EFA) has its own requirements, documentation rules, and approval processes

  • Families are solely responsible for confirming that purchases comply with current state guidelines

  • We do not guarantee that any product, class, or service will be approved or reimbursed

  • Herb Sprouts Learning is not responsible for denied, delayed, audited, or reversed reimbursements

You agree that any submission to Arizona ESA or Arkansas EFA is your responsibility as the account holder.

4. Payments, Access & Refund Policy

All prices are listed in USD.

Because our offerings include live Zoom classes, digital access, and downloadable educational materials, all sales are final once access is granted.

This includes:

  • Live Zoom class enrollment

  • Class recordings (if provided)

  • Downloadable PDF worksheets and curriculum materials

  • Digital bundles or lesson access

No refunds will be issued once access has been delivered.

If a class is canceled by us, students will be offered a make-up session or alternative access.

ESA/EFA families are responsible for submitting reimbursement requests directly to their respective state programs.

5. Intellectual Property & Copyright Agreement

All content provided by Herb Sprouts Learning, including but not limited to:

  • Zoom class content (live or recorded)

  • PDF worksheets and downloadable curriculum

  • Lesson plans, written materials, graphics, and illustrations

  • Website content and educational frameworks

is the exclusive intellectual property of Herb Sprouts Learning and is protected under copyright law.

By accessing our materials, you agree that:

  • Content is licensed for single-family, personal, or household educational use only

  • You may print worksheets only for your own enrolled student(s)

  • You may not copy, share, resell, upload, distribute, or reproduce any materials in any form

  • You may not share Zoom links, recordings, login access, or downloadable files with others

  • You may not use our materials to teach outside students, classes, or programs without written permission

Unauthorized use, reproduction, or distribution of any materials is strictly prohibited and may result in revoked access, legal action, and denial of future enrollment.

6. Zoom Class Access & Conduct

Live Zoom classes are provided for enrolled students only.

You agree that:

  • Zoom links, passwords, and meeting access are confidential and non-transferable

  • Recording, screenshotting, or redistributing any portion of live or recorded classes is strictly prohibited

  • Only registered students and authorized guardians may attend sessions

  • Disruptive behavior, harassment, or unsafe conduct may result in removal without refund

We reserve the right to remove any participant who violates these terms or disrupts the learning environment.

7. Child Safety & Supervision

Parents or legal guardians are fully responsible for supervising all participation in:

  • Herbal handling and identification

  • Kitchen-based or hands-on activities

  • Tool use or crafting materials

You agree to ensure a safe learning environment at all times.

8. Health & Allergy Disclaimer

Some herbs, plants, or materials used in instruction may cause allergic reactions or sensitivities.

By enrolling, you accept full responsibility for:

  • Checking ingredient safety

  • Monitoring allergic reactions

  • Consulting a qualified healthcare provider when appropriate

9. Limitation of Liability

To the fullest extent permitted by law, Herb Sprouts Learning is not liable for any:

  • Injuries or accidents

  • Allergic reactions

  • Property damage

  • Financial losses

  • Misuse of materials or tools during participation

All participation is at your own risk.

10. Privacy

We collect only the information necessary to:

  • Provide educational services

  • Process payments

  • Communicate with families

  • Generate invoices for ESA/EFA documentation where applicable

We do not sell or share student data with third parties.

11. Governing Law

These Terms are governed by the laws of the State of Arizona.

Any disputes shall be brought in Pinal County, Arizona.

12. Updates to Terms

We may update these Terms at any time. Continued use of our website, Zoom classes, or digital materials after changes are posted constitutes acceptance of the revised Terms.
